The purpose of this voluntary program is to allow motorists who have good driving records to maintain those records. In addition, the money collected will help pay expenses for the Prosecutor's Office and other local law enforcement agencies.


If you have already paid your ticket at the clerk's office, we cannot accept you on this program.

You are eligible for the infraction deferral program if:

  • You have not been convicted of drunk driving within the past 5 years.
  • You are not an habitual traffic offender.
  • You do not carry a CDL license.
  • You must have a valid driver's license.
  • You have not had a traffic conviction for a moving violation in Vanderburgh County in the past 2 years and have not participated in the Vanderburgh County Infraction Deferral Program on a moving violation in the past two (2) years.
  • Your present ticket(s) were not issued in relation to an accident or speeding in a school or construction zone or failure to yield to an emergency vehicle.
  • Your present ticket(s) are for one of the offenses listed below.
  • You are not presently enrolled in any other deferral program in another county.

To take advantage of this voluntary program you must:

  • Sign the infraction deferral agreement (sample shown below) and have it postmarked and mailed to the Prosecutor's Office, Room 108, Civic Center Complex, Evansville, Indiana, 47708 at least 10 days before your court appearance date.
  • Enclose a money order or a cashier's check in the amount of $127 per ticket unless the ticket is a seat belt violation. A seat belt violation is only a $25 fee. Your cashier's check or money order should be made payable to the Vanderburgh County Infraction Deferral Program.
    Cash, personal checks, and business checks are not acceptable. Also, payments are not accepted online.

  • Enclose your ticket(s) with your payment and agreement.
  • If you are between the ages of 16 and 24 and your ticket was issued for one of the violations marked with an asterisk * on the list below, you are required by the court to enroll in and complete the Alive at 25 Defensive Driving Course at Ivy Tech Community College. For information on class times and fees, please call Ivy Tech at (812) 429-9807.

If you meet the above requirements your ticket(s) will be dismissed. Further, the traffic violation will not go on your permanent driving record. If you would prefer to pay your program fee in person, you may do so by bringing your payment and ticket to the Prosecutor's Office no later than 3 business days before your court appearance date.

If you fail to pay in person or mail the agreement, payment, or ticket to us in a timely fashion you may be denied participation in this program and must either appear in court or pay your fine and court costs as indicated on your ticket.

Infraction Deferral Agreement

Payments for this program cannot be made online.

Comes now the State of Indiana and the defendant and agree pursuant to I.C. 34-4-32-1 that this cause will be dismissed on the following conditions:

  • The defendant swears under penalties of perjury that:
    a. I am not currently enrolled in any other deferral program in another county.
    b. I have not been convicted of drunk driving within the past 5 years.
    c. I am not an habitual traffic offender.
    d. I have not had a previous moving traffic conviction in Vanderburgh County in the past 2 years and have not participated in the Vanderburgh County Infraction Program for a moving violation in the past two years.
    e. My present ticket(s) was not issued in relation to an accident or speeding in a school or construction zone or for failure to yield to an emergency vehicle.
    f. I do not presently have a CDL license.
    g. I have a valid driver's license.
  • The defendant agrees not to commit any additional traffic violations for one year from the date of their signature below.
  • The defendant has paid a nonrefundable $127 per ticket (except for a seat belt violation) to the Vanderburgh County Infraction Deferral Program. A seat belt violation is only a $25 fee.
  • The defendant must enroll in and complete the Alive at 25 Defensive Driving Course within 60 days if the ticket was for any of the offenses marked with an asterisk * and the defendant is between 16 and 24 years of age. Please contact Ivy Tech Community College at (812) 429-9807 for class times and fees. NO COURT APPEARANCE IS NECESSARY IF YOU ENTER THIS PROGRAM.
  • The defendant acknowledges if any of the above terms are violated or if the defendant fails to complete the Alive at 25 course the State may submit the defendant's record to the Bureau of Motor Vehicles.

No court appearance is required for this program.

Wherefore, the State of Indiana and the defendant mutually agree this cause will be dismissed pursuant to this agreement.
